The Women & Child Development Department, Mumbai City Collectorate, Government of Maharashtra has issued an Order requiring all establishments in the city of Mumbai to register their Internal Complaints Committee (ICC) constituted under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013 (POSH). The state of Telangana has issued a similar Order.

Applicability

Under Section 4 of POSH, it is mandatory for all workplaces having ten or more employees to frame a Policy and constitute an Internal Complaints Committee under the Act for each of the offices separately.

The Order is addressed among others to cooperative societies, non-governmental organizations, trusts, hospitals, welfare centers, sports organizations, education institutions etc.

In view of the Order, all establishments (including NGOs, charitable organizations employing ten or more persons) will be required to furnish the details. Where the state of Maharashtra is concerned this requirement, as of the moment, appears to be limited to establishments in the district region of Mumbai only.

Due date and consequences of failure

As per the Order, the details of the ICC of establishments in Mumbai should be submitted by 20th July 2019 and failure to submit the same would attract penalty of INR 50,000.00.

Where to submit?

Establishments in Maharashtra are required to fill in the details of their ICC in the prescribed form and submit it to the Sub-Divisional Magistrate, Old Custom House, Shaheed Bhagat Singh Road, Fort, Mumbai – 400001 on or before 20 July 2019.

Establishments in Telangana employing ten or more employees are required to register their ICC with the State Shebox portal latest by 15 July 2019. The web-portal for registration of ICCs in Telangana is: https://tshebox.tgwdcw.in

Note:

Once the Internal Committee is established, the Presiding Officer and each Member of the ICC shall not hold office for more than 3 years.
As per Section 21 of the POSH Act, at the end of every calendar year, i.e. in the month of December, the Internal Complaints Committee shall prepare and submit or send an annual report to the District Officer and Sub District Officer, at Local District Office, Old Custom House, Shahid Bhagat Singh Marg, Fort, Mumbai, Maharashtra 400001.
